Meatyum Terms of Use (Terms and Conditions)

Welcome to Meatyum, owned and operated by MEATDELIGHT TECHONOLOGIES PVT LTD ("MEATYUM", "We", "Us", or "Our"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application and website (collectively, the "Platform") for ordering fresh meat and seafood products.

By accessing, browsing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.


1. Introduction and User Eligibility

1.1 Acceptance of Terms

By using/accessing the Platform, you signify your acceptance of these Terms and any other policies published on the Platform, as amended from time to time.

1.2 Who Can Sign Up

The Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. By completing the registration or placing an order, you represent and warrant that you are:

  • Aged 18 years or older.
  • Of sound mind.
  • Not disqualified from contracting by any law.

2. Terms of Site Access and Account Security

2.1 Limited Right to Use

MEATYUM grants you a personal, limited, non-exclusive, non-transferable, and revocable privilege to access and use the Platform for personal consumption only.

2.2 Prohibited Activities

You are expressly prohibited from:

  • Downloading (except for page caching), editing, or reproducing any content.
  • Using the Platform or any data for commercial purposes, including resale of products or use of listings/descriptions for external businesses.
  • Using data mining, robots, or similar data gathering and extraction tools.
  • Falsely representing your identity or impersonating another person.

2.3 Account Security

You are solely responsible for all activities that occur under your Account. You shall promptly update your account information to ensure it is always complete, accurate, and up-to-date. MEATYUM reserves the right to suspend or terminate your account if any information provided is found to be untrue, inaccurate, or incomplete.


3. Order Placement and Product Specific Terms (Perishable Goods)

3.1 Freshness Guarantee and Product Representation

MEATYUM ensures that all products are fresh and not frozen at the time of dispatch from our facility.

  • Weight Variance: The Customer acknowledges that products like custom-cut fish or meat may have minor weight variances post-cutting/cleaning.
  • Natural Variation: Due to the inherent nature of raw products, MEATYUM does not guarantee that product images and colours will be an exact match to the delivered item. Natural variation in size, colour, and appearance is expected and shall not be a basis for return or refund.

3.2 Customer’s Mandatory Duty of Care for Perishable Goods

The Customer acknowledges that all products purchased are highly perishable. Upon successful delivery, the responsibility for maintaining the product's quality and safety shifts entirely to the Customer.

The Customer agrees to adhere to the following mandatory storage guidelines:

  • The product must be placed in a refrigerator or deep freezer immediately upon receipt.
  • For optimal taste and quality, consumption must occur within 24 hours of delivery.
  • MEATYUM disclaims all liability for any quality degradation, spoilage, or illness resulting from improper storage, delayed refrigeration, or consumption later than 24 hours after delivery.

3.3 Allergen and Cross-Contamination Disclaimer

The Customer acknowledges that MEATYUM's facility processes multiple product types, including chicken, various fish, and prawns. While MEATYUM maintains strict hygiene and separation protocols, we cannot guarantee that any product will be completely free from trace amounts of allergens from other food products processed within the same facility. Customers with severe allergies or specific dietary restrictions consume products at their own risk.


4. Cancellation, Returns, and Failed Delivery Policy

4.1 Order Cancellation Window

Due to the quick commerce model and the customized nature of raw meat preparation (cutting, cleaning, packaging):

  • A Customer may cancel an order only within two (2) minutes of placing the order on the Meatyum Platform.
  • Any cancellation request made after this 2-minute cutoff will be rejected, and the Customer will be charged the full order value.

4.2 Right to Refuse Cancellation

Notwithstanding Section 4.1, MEATYUM reserves the absolute right to reject any cancellation request if the order has already been physically assigned for cutting, processing, or dispatch from the facility. In such cases, the order will be processed and delivered, and the Customer will be liable for the full payment.

4.3 Consequences of Failed Delivery (No Refund)

If a delivery fails solely due to the Customer's action, including (but not limited to) Customer Unavailability, providing an Incorrect Address, or Refusal to Accept the order for non-spoilage reasons:

  • The product will be immediately recalled by MEATYUM and disposed of due to its highly perishable nature.
  • No refund will be provided to the Customer. The full order value, including any delivery charges, remains payable, as the goods are customized and cannot be resold.

4.4 Returns and Refunds for Quality Issues

A refund or replacement may only be considered if the product is visibly spoiled or damaged upon delivery. Any such claim must be notified to MEATYUM support immediately upon receipt of the order and be supported by photographic evidence.


5. Customer Obligations and Conduct

5.1 Lawful Use

You agree to use the Platform lawfully and provide truthful and complete information.

5.2 Prohibition on Objectionable Content

You must not upload, share, or transmit any objectionable, harassing, libelous, abusive, or unlawful content.

5.3 Respectful Treatment of Delivery Partners

You agree not to discriminate against any delivery service providers based on race, religion, caste, creed, national origin, disability, or gender identity. Any credible proof of such discrimination, verbal abuse, or harassment will result in the immediate and permanent suspension of your account.


6. Intellectual Property Rights

6.1 Ownership

All content, including text, graphics, logos, images, software, and materials on the Platform, is protected by copyright and trademark laws and is owned or licensed by MEATYUM or its partners. Access to the Platform does not confer any intellectual property rights to the Customer. Reproduction or reuse is prohibited without prior written permission.

6.2 Customer Reviews & Feedback

Any feedback (comments, suggestions, reviews, etc.) submitted by the Customer becomes the property of MEATYUM. By submitting feedback, you grant MEATYUM a perpetual, worldwide, royalty-free, and transferable right to use, modify, and distribute such feedback without compensation or attribution to you.


7. Disclaimer of Warranties and Indemnity

7.1 Disclaimer on Safe Handling and Cooking

MEATYUM disclaims all warranties regarding the final safety of the product once it has been delivered. The Customer is solely responsible for ensuring proper cooking temperatures, safe handling practices, and preparation techniques to prevent foodborne illness.

7.2 Indemnity

The Customer agrees to defend, indemnify, and hold harmless MEATYUM and its associates, officers, directors, and employees from any claims, damages, or losses arising from or related to:

  • The Customer's breach of these Terms.
  • The Customer’s violation of any applicable law.
  • IP infringements.
  • Losses caused to other customers.

This indemnity clause shall survive the termination of this agreement.


8. Governing Law and Dispute Resolution

8.1 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

8.2 Dispute Resolution

All disputes or claims arising out of or relating to these Terms or the Platform shall be settled by binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Mumbai, Maharashtra, and the proceedings shall be conducted in the English/Hindi language. The Courts in Mumbai shall have exclusive jurisdiction over any matter arising out of or in connection with the arbitration proceeding.


9. Modification of Terms

MEATYUM reserves the right to change, modify, or update these Terms at any time without prior notice. By continuing to access the Platform after any such changes, you agree to be bound by the latest version of the Terms.
